Background

1. From time to time Goldpower Energy Limited undertakes competitions, contests, or prize draws (“promotions”) on its Facebook page at www.facebook.com/goldpowerelectrical or on its website.

2. By entering any promotion participants agree to be bound by these Terms and Conditions, including any specific entry instructions when entering any promotion on the Goldpower Electrical Facebook page or on its website.

3. The terms and conditions for specific promotions are to be read in conjunction with these General Terms and Conditions (“Conditions”). The provisions of Specific Terms and Conditions will apply where there is any inconsistency with the General Terms and Conditions.

Eligibility to participate

1. Any person can enter Goldpower Energy promotion provided they comply with the Specific Terms and Conditions specific entry instructions.

2. Participants must reside in New Zealand to enter a promotion.

3. Entrants must be 18 years of age or older to enter. Entrants aged 14 years and older may enter with the consent of their parent or guardian before entering the promotion. Some promotions may have specific age requirements as specified in the Facebook post or other method of advertising the promotion.

4. No person can enter any promotion of Gold Power Energy if they or a member of their immediate family works for Goldpower Energy.

5. Goldpower Energy reserves the right to check each participants eligibility for the promotion and to disqualify any entrant if in the opinion of Goldpower Energy the entrant does not fit the eligibility criteria.

Entry

1. To enter any promotion participants must follow the specific entry instructions as outlined in the relevant post on the Goldpower Energy Facebook page or other method of advertising the promotion.

2. All participants must follow these Terms and Conditions to be included in the promotion. Goldpower Energy will not give any confirmation to participants that they have successfully entered the promotion.

3. Participants are limited to one entry per person, unless the promotion specifies otherwise.

4. Promotions will be open during the time specified on the relevant post advertising the promotion. Each individual promotion’s duration will be listed at the bottom of these terms and conditions. No entries can be made after the promotion’s closing date.

5. If an entry is lost, delayed, undelivered, or is a multiple entry it will not qualify as a valid entry. Goldpower Energy accepts no responsibility for entries which are not successfully lodged due to any computer or technological error or any reason whatsoever.

Successful entries

1. Upon entry participants become eligible to win the prize or prizes as specified in the relevant promotional post or communication.

2. Goldpower Energy will notify winners of prizes via a private Facebook message or other method should details be available within 7 days of winning a prize. Winners will receive their prizes within 28 days of being notified.

3. Winners must supply the correct postal or email address within 14 days of being notified in order to receive the prize. Winners may be requested to produce proof of identity before claiming a prize.

4. Prizes cannot be redeemed or exchange for a different prize or cash. All prizes are as stated in the corresponding post advertising the promotion. Goldpower Energy reserves the right to offer an alternate prize of equal or greater value if it is unable to provide the original prize as originally stated in the promotion.

5. Prizes do not come with any warranty or guarantee as to their fitness for purpose unless expressly given.

6. If winners do not claim a prize within 14 days of being notified or cannot take a prize, and Goldpower Energy has made reasonable attempts to contact them then the prize will be deemed to be forfeited by the winner. Then Goldpower Energy will select and distribute the prize to a new winner. Goldpower Energy accepts no responsibility or liability for distributing any prize to a new winner when the original winner does not claim or cannot take the prize.

7. By participating in the promotion, all prize winners agree to participant in all promotional, public or marketing activity requested by Goldpower Energy and the use of the winner’s image (still or moving) or voice recording without any payment from Goldpower Energy.

Personal information of participants

1. Goldpower Energy will collect the personal information of participants and use this information only for the administration of the promotion. Personal information of participants will not be used for any other purpose without the consent of the participant.

2. Goldpower Energy will comply with the provisions of the Privacy Act 1993 in storing any personal information of participants.

3. Personal information of participants will be stored for the duration of the promotion and then destroyed. Participants may change their personal information held by Goldpower Energy at any point during the promotion.

Liability

1. To the fullest extent possible by law, Goldpower Energy is not liable for any loss or damage or injury whatsoever which is suffered from participating in the promotion.

2. Goldpower Energy will not be responsible for third party products and services offered as prizes. Such prizes will be subject to the terms and conditions of those third parties.

General

1. If any participants engage in any conduct or activity on Facebook which in the opinion of Goldpower Energy breaches Facebook’s terms and conditions, then Goldpower Energy reserves the right cancel the participant’s entry and alert Facebook to such behaviour.

2. Goldpower Energy reserves the right to withdraw or amend the promotion if exceptional circumstances arise affecting the promotion which are outside the reasonable control of Goldpower Energy.

3. These terms and conditions shall be governed by in accordance with the laws of New Zealand. New Zealand law shall have exclusive jurisdiction in relation to any disputes arising in respect of any promotion by Goldpower Energy.

If Goldpower Energy has reasonable grounds to believe any participant has breached these terms and conditions, Goldpower Energy may, in its sole discretion, disqualify the participant and prevent them from entering any promotion in the future.
